1)  Important Information

By accessing, browsing or placing an order on this website you agree to be bound by the associated terms, conditions, disclaimers and limitations of liability (Terms & Conditions).

Oobi Clothing reserves the right to amend or update the Terms & Conditions at any time without providing notice to you.

By using the website, you acknowledge that you have read and understood the Terms & Conditions.

2)  Products & Purchasing

 a) Availability

  •  Offers on special product mark downs, sample clothing or sale items are available until stocks sell out.
  • All orders are subject to availability of stock and confirmation of the order price.
  • All efforts will be taken to process orders within 1-2 business days from the date the order is lodged.

 b) Product Pictures

All colours of garments are reproduced as accurately as possible, however a slight variation may occur in colour and size specifications. Colours may appear slightly different via this web site due to computer picture resolution and individual monitor settings.

 c) Pricing and Payment

All prices are quoted in AUD (Australian Dollars) and are inclusive of GST.

Oobi Clothing does not guarantee the price of any item listed on this website until your order has been processed. Whilst Oobi clothing takes steps to ensure the price and details of products listed are correct, if they are incorrect, Oobi Clothing reserves the right to cancel the order and refund. Any orders received by Oobi Clothing through this website constitute offers and are subject to acceptance by Oobi Clothing in its absolute discretion.

Oobi Clothing reserves the right to take reasonable steps to verify that the order and credit details are bona fide. Delays may occur as a consequence of this process.

 d) Sale items and special product mark downs

Special product mark downs, sample clothing or sale items that appear on this website are only available when ordering online and are only available until such stocks sell out.

 e) Changing an Order

Unfortunately no changes to orders may be made after they have been submitted. If you are unhappy with your purchase once you receive it, you may return it to us. See below for further information regarding returns and exchanges.

c) Other Important Information to Note Regarding Returns

 The item(s) must be returned in a new, unworn, and unwashed condition. All original tags must still be attached. Please also include the original invoice. Delivery costs will only be reimbursed if the wrong item was delivered or if the item was unknowingly defective.

Oobi Clothing WILL NOT  at any of our retail stores allow an exchange or return of any items ordered online using this website.

PLEASE NOTE: We DO NOT accept exchange or refund requests for special product mark downs, sample clothing, sale item or items that are no longer stocked unless the goods are unknowingly defective.

We reserve the right to refuse a returned product that is damaged by the recipient due to lack of care or disregard of care or washing instructions.

The item(s) remains your responsibility until it reaches us, so for your own protection we recommend that you send the parcel using a delivery service that insures you for the value of the goods. We will not refund return items which are damaged or lost in the post. 

d) Please note that Oobi Underwear in non returnable for hygiene reasons.

5)  Disclaimer

The information contained on the website is provided by Oobi Clothing in good faith. To the best of Oobi Clothing’s knowledge, the information is accurate and current. However, Oobi Clothing, its related bodies corporate and any of their respective directors, officers, employees, consultants or shareholders do not make any representation or warranty as to the accuracy or completeness of the information.

To the fullest extent permitted by applicable law, Oobi Clothing disclaims all representations and warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, non-infringement, availability of products, quality, completeness, suitability and accuracy. Oobi Clothing makes no warranty that this website, any information or ideas contained on this website or any products or services will meet your requirements.

6)  Limitation of Liability

Subject to any applicable law that cannot be excluded, Oobi Clothing and its related bodies corporate will not be liable to you or any other person for any non-excludable direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for product liability, personal injury or negligence resulting from or in connection with products or services available or supplied to you, or on your behalf, through the website.

For all other claims or liability, as fas as permitted by law, the maximum liability of Oobi Clothing and its related bodies corporate for any loss, damage or claim whatsoever arising out of or in connection with this website, these terms and conditions, any products or services available or supplied to you through, or on your behalf, through this website will be $100.00 in aggregate for all claims by a customer. Oobi Clothing or its related bodies corporate will not in any case be liable for any lost profit (direct or indirect), deletion or corruption of electronically or digitally stored information or incidental, consequential or special damages arising out of or in connection with this website, the content and the products and services available or accessible on the website.

7) PRIVACY

All personal information submitted by you through the Oobi Clothing website will be treated in accordance with Oobi Clothing’s obligations under the Privacy Act 1988 (Cth) and its privacy policy. For the purposes of the Spam Act 2003 (Cth), by placing your order you will be deemed to have consented to Oobi Clothing and its related bodies corporate placing your contact details on our database and sending you information (including by email) regarding sales, products or other matters which may be of interest to you. If you do not wish to receive such material, please contact Oobi Clothing.

Personal information may be disclosed to third parties where required, for example, to fulfil our services or for related purposes.

Participants in interactive activities (including, but not limited to, contests, membership programs, message boards, purchases, newsletter subscriptions, surveys) may be asked to provide personal and other information. This information may be used to communicate promotional offers or related information about our company, our partners and relevant third parties. In addition, such information may be used to design the marketing messages received by the recipients. Please contact us if you do not wish to receive such messages or offers.

Please note that Oobi Clothing does not have control over any sites linked to our website. Linked sites may have different privacy policies. As such, we do not accept any responsibility for any linked sites or for any loss or damage that may arise from your use of them.

8) SECURITY

The security of your credit card and other payment details and information is of paramount importance to us and will only be utilised as required in order to process orders placed by you.

When purchasing online, your payment details are processed securely using 128-bit SSL (secure socket layer) encryption to protect you. In addition, all electronic payment information is stored with password protection, so that it remains confidential and secure.

It is important for us that persons with whom we do business have confidence that we handle information responsibly and it is our policy to do this.

9)  INTELLECTUAL PROPERTY

 Images, text, site design, logos, graphics and any other content and software on this site, including their arrangement, selection and assembly, are the property of Oobi Baby and Kids Pty Ltd (or one of its related entities), unless specified otherwise.

You may use this web site only for your personal and non-commercial purposes.

Except to the extent permitted by relevant legislation, you must not use, copy, modify, transmit, store, publish or distribute any material on this web site or create any other material using material on this web site, without obtaining our prior written consent.

Unauthorised use of the images, designs and other materials appearing on this site may violate copyright, trademark and other applicable laws and may result in criminal or civil proceedings and penalties.

10)  USE OF IMAGES 

When Oobi collects pictures, photos and images from you it is because you are voluntarily submitting those images to us if you choose to participate in Oobi activities like contests, games and surveys, etc, or because you want us to furnish you with products, services, newsletters, or information, or in connection with content or suggestions you submit to Oobi for review.

Upon providing Oobi with such images, you will be deemed to acknowledge and agree to the use by Oobi of your images on this website for marketing purposes associated with Oobi Clothing.  Oobi will not otherwise share your images with third parties unless you have given Oobi permission to do so.

11)  JURISDICTION

These terms are governed by and must be construed in accordance with the laws of New South Wales, Australia. You submit to the jurisdiction of the courts of New South Wales and the Commonwealth of Australia in respect of all matters arising out of these terms.

12) SEVERABILITY

Each provision of these terms (or any part thereof) is severable from the others and no severance of a provision (or any part thereof) will affect any other provision or remaining part provision.

13) CUSTOMER GUARANTEE

 Oobi Baby and Kids will always endevour to provide the best price, quality and customer service when possible to ensure you the customer will always be delighted!

 

14) GIFT WITH PURCHASE:

The Free Gift With Purchase is chosen randomly by Oobi. There will be no exchanges, refunds or substitutions on Gift With Purchase items. Please also note that gift with purchase may vary from image. Gift With Purchase may be supplied in different colours or designs from those photographed. Note that the value of the Gift With Purchase is reflected by the price indicated on the oobi.com.au website. Please do not request specific sizes, colours or designs for Gift With Purchase as we can only supply them as random selections. Please note that free gifts are one per order despatch - so if you place more than one order close together to the same address and your orders are despatched together you will receive one free gift for that despatch.


15) VIP MEMBERSHIP:

a) All VIP Club customer orders received before 2pm on any business day will be dispatched same day. All other customer orders received will be dispatched within 1-2 business days. VIP Members are offered free domestic delivery to a nominated address on orders over $50*, earlybird access to sales on the Oobi Webstore and from time to time exclusive VIP garments created specifically for VIP Members and limited to one garment per VIP Account.

b) Participation in the VIP Membership Program is open only to individuals and can not be used as part of a group and should not be used to send orders to other addresses than the account owner.

c) Membership may be cancelled/refused to individuals by Oobi at its discretion, if Membership is deemed to be fraudulent, in breach of Oobi Terms and/or being used as a group.

d) Membership to The VIP Club entails an annual $29.95 Membership fee and Membership continues for 12 months.

e) Oobi reserves the right to change the VIP Club Benefits and terms anytime without notice. Terms will be updated on oobi.com.au

 

*Updated from $40 to $50 on the 13/12/2013. All VIP Members that purchased VIP Membership on or before 13/12/2013 will still receive free domestic shipping to their nominates address on orders over $40 for the remainder or their VIP Membership year, when this year expires these members will be offered the new VIP terms and free domestic shipping on orders over $50

16) PRE-ORDER & SPECIALLY MANUFACTURED PRODUCTS

A non-refundable deposit of 20% is taken when any product is pre-ordered and/or is manufactured acoeding to that order. When your ordered item arrives in stock we'll let you know it has arrived and require full payment before your item is despatched. The order must be paid for in full within 14days of the notification we send to let you know the item has arrived and is ready for despatch. If the item is not paid in full by these 14 days or is cancelled by the purchaser the 20% deposit will not be refunded.


LAY-BY TERMS & CONDITIONS

A 6-week lay-by is available on full priced non sale items with a total order value of no less than $300. Please note that some items are not available for lay-by.

You will need to have an account with us to place a lay-by. You can create an account via the link below.

A 20% deposit is required upfront, as well as fortnightly payments for the term of the lay-by.

You are able to make payments via either PayPal or card and receipt will be emailed to you after each payment.

A termination fee of 10% of the total lay-by amount will be charged, should you decide to cancel your lay-by agreement at any time within the term of the lay-by.

Once the total amount of your lay-by has been paid and cleared, your items will be shipped to you on the same day, or the next business day.

It is the responsibility of the customer to advise this store of any change of details (address, phone number, etc).

1. These terms and conditions together with any specific rules set out in Competition Notices apply to competitions on http:// <http://oobi.com.au> www.facebook.com/oobibabyandkids. By entering a Competition, entrants agree to be bound by these Rules.
  2. OOBI reserves the right to cancel or amend the Competition or the Rules without notice or anticipated breach of any applicable law or regulation or any other event outside OOBI’s reasonable control. Any changes will be posted either within these terms and conditions or the Competition Notice.
  3. In the event of any dispute regarding the Rules, conduct, results and all other matters relating to a Competition, the decision of OOBI shall be final and no correspondence or discussion shall be entered into.

Qualifying Entrants
  
4. This Competition is open to entrants from outside Australia. However you are not entitled to enter the Competition if you are resident in a country or jurisdiction where the Competition may breach any law or regulation. Where this applies, OOBI Pty Ltd’s invitation to enter the Competition in such country and/or jurisdiction is withdrawn.
  5. OOBI Pty Ltd reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Rules.
  6. In the event that any entrant is disqualified from the Competition, OOBI Pty Ltd in its sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.
Please note that all entrants but me subscribers to the Oobi Newsletter for their entry to any competition to be valid.

7. Unless stated otherwise in the Competition Notice, you may enter the Competition as many times as you like.
  8. Competition entries must be made in the manner and by the closing date and time specified on the Competition Notice. Failure to do so will disqualify the entry.
  9. Proof of posting or emailing cannot be accepted as proof of delivery. OOBI Pty Ltd cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to Entries, or Entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs, Facebook post/shares being private due to your account settings or other causes outside OOBI Pty Ltd’s control.
  10. Entrants should note that unless stated otherwise, OOBI Pty Ltd does not accept responsibility for the return of any Entries, including those consisting of artistic or other material.
11. If your post/share entry is not visible to OOBI Pty Ltd due to your Facebook account settings, OOBI Pty Ltd cannot accept your share/post as an entry, OOBI Pty Ltd holds no responsibility for your entries not being valid due to not being visible because of your Facebook Privacy Account Settings.

 
 Prizes
  
11. Unless stated otherwise in the Competition Notice, prize winners will be chosen at random from all correct Entries (for competitions involving answering questions or where entry is by emailing or otherwise providing a name and/or contact details to OOBI Pty Ltd) or from all submitted entries (where creative or artistic merit or other subjective criteria apply to entries), within 28 days of the closing date specified in the Competition Notice. Tie-breakers will be judged by OOBI Pty Ltd and, if required by law, by an independent adjudicator. In all matters, the decision of the judge(s) and OOBI Pty Ltd shall be final and no correspondence or discussion shall be entered into.
  12. Prize winners will be notified in the manner and within the time specified on the Competition Notice and may be contacted by OOBI Pty Ltd. Return of any prize notification as undeliverable or failure to reply as specified in the notification (and within the time stated) may result in disqualification and selection of an alternate winner. Only one prize per entrant will be awarded. Competition winner(s)’ names may be published on the website.
  13. Claims for prizes must be made in the manner and within the time specified on the Competition Notice. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.
  14. Prizes are non-transferable and there is no cash alternative. OOBI Pty Ltd reserves the right to substitute prizes of equal or greater value at any time.
  15. Prizes are awarded at OOBI Pty Ltd’s discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant. Where Entries are being judged on creative or artistic merit or other subjective criteria, OOBI Pty Ltd and/or the Competition judges (acting reasonably) reserve the right not to select a winner, and/or to remove or amend selection criteria and/or the structure and operation of the Competition if Entries are not of the requisite standard.
  16. Where a prize may not be appropriate for a younger contestant, the minimum age for entry will be stated in the Competition Notice and must be observed. OOBI Pty Ltd reserves the right to request written proof of age of any winner.
  17. All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses upgrades etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner.
 
 18. Due to a tie prize value may be split between winners.
 
 19. An entrant can enter more than once and win more than once and will be added into the draw automatically.
 
 Intellectual Property Rights & Use of Entries
  
18. OOBI Pty Ltd does not, unless we agree this with you, claim any rights of ownership in your Entry. As such, you retain ownership of your Entry and, although OOBI Pty Ltd will be able to use Entries as set out in the Rules, you will also have the right to use your Entry in any way you choose. Where any Entry is to be used in a different way (e.g. we are asking to own this) this will be made clear on the website and you will then be able to choose whether to enter the Competition. If you win a prize, as a condition to receipt of that prize, you may be required to sign a release form (in OOBI Pty Ltd’s then current standard form) in connection with the prize-winning submission.
  19. In consideration of OOBI Pty Ltd agreeing to consider entrants to the Competition, each entrant hereby agrees that OOBI Pty Ltd (and third parties authorised by OOBI Pty Ltd) may make any and all Entries available on the website and any other media, whether now known or invented in the future, which may include other internet sites, mobile, television and/or radio and that Entries may be made available with advertising and/or sponsorship. You now grant OOBI Pty Ltd (and third parties authorised by OOBI Pty Ltd) a non-exclusive, worldwide, irrevocable licence (for the full period of any rights in the Entry) to use, display, publish, transmit, copy, make derivative works or podcasts from, edit, alter, store, re-format, sell and sub-licence the Entry for such purposes.
  20. OOBI Pty Ltd does not guarantee to use or otherwise make available any Entry. OOBI Pty Ltd may also, in appropriate circumstances, and at its sole discretion, reject, edit, remove or disable access to Entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory etc. or for any other reason.
 
 21. Your Entry and any information submitted by you must be personal to and relate specifically to you. You hereby warrant that your Entry and all information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libelous, defamatory, obscene, indecent, harassing or threatening. If relevant, OOBI Pty Ltd reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.

 Liability
  
22. OOBI Pty Ltd cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize. OOBI Pty Ltd is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude OOBI Pty Ltd’s liability for death or personal injury as a result of its negligence.
 
 23. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. Any questions, comments or complaints regarding the promotion must be directed to Oobi Baby&Kids 511B-515 Botany Rd, Zetland, 2017, not to Facebook. The information you provide will only be used in the ways outlined in these Terms and Conditions.
 
 24. Oobi Baby&Kids take no responsibility to your privacy settings of your account. If you have shared or Liked an oobi Baby & Kids post and we cannot identify you due to your privacy settings, Oobi Baby&Kids have the rights ti disqualify the entry.
